Terms and Conditions

Scope of Application

The General Terms and Conditions (hereinafter referred to as the “GTC”) govern the relationship between Dorbena AG (hereinafter referred to as “Dorbena”) and customers of the Dorbena online store. The GTC are an integral part of every contract between Dorbena and a private customer.

Dorbena reserves the right to amend the GTC at any time. The version of the GTC in effect at the time of the order shall apply, and may not be unilaterally amended with respect to the existing order.

Provisions deviating from the Terms and Conditions apply only if they are confirmed in writing by Dorbena.

Orders may only be placed in the Dorbena online store by individual customers who are at least 18 years of age and have their residence and shipping address in Switzerland or Liechtenstein.

Offer

The offer is valid as long as it is visible in the online store and/or while supplies last. However, the presentation of a specific product on the website does not imply that we guarantee its availability. We are only obligated to deliver goods that are in stock. We reserve the right to either cancel the order or make a partial delivery. In such a case, we will notify the buyer accordingly.

Price- and product range changes are possible at any time. The images shown in advertisements, brochures, the online store, etc., as well as all product information, are for illustrative purposes only and are not binding. lowMinor deviations in size and workmanship are reserved. We exclude any liability for incorrect or incomplete information and representations.

Prices

Prices are quoted in Swiss francs, including the statutory value-added tax (VAT). The price listed in the online store at the time of the order is decisive, with the exception of obviously incorrect price listings (e.g., CHF 0.00). Prices are specified in our order confirmation, plus any applicable shipping costs. The products remain the property of Dorbena until the purchase price has been paid in full.

Registration

It is up to the buyer to choose whether to register for the Dorbena web shop or to place an order as a guest without registering. However, certain features of the website are available only to registered customers.

Upon registration—i.e., the creation of a customer account—the buyer is obligated to provide truthful personal information. Dorbena reserves the right to delete customer accounts at any time, without providing a reason, or to block a username and the password.

The personal password chosen by the customer during registration is not known to Dorbena and must be managed and kept confidential by the customer. The customer is responsible for all actions performed on the website using the password, even without the customer’s knowledge.

More detailed information regarding the processing of personal data by Dorbena in connection with registration, use of the website, and purchases in the online store is set forth in the Privacy Policy.

Order

The display of products in the online store does not constitute a legally binding offer, but rather a non-binding online catalog or a non-binding invitation to the customer to order the product in the online store. Dorbena AG reserves the right to limit the quantities supplied for certain products and to refrain from fulfilling the order if it does not correspond to a quantity typical for a household.

An order is considered an offer to the online store to enter into a contract. After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by Dorbena. Upon receipt of this confirmation, the customer can no longer change the order and is bound by it.

Dorbena is free to reject orders in whole or in part without providing a reason. In this case, the customer will be informed, and any payments already made will be refunded. Further claims are excluded.

The contract for an online order placed in the Dorbena Webshop is concluded by clicking the “Order” button.

Delivery

The estimated delivery time is displayed in the web shop. All information regarding availability and delivery times is subject to change and may vary at any time.

Dorbena places great importance on keeping availability and delivery times in the webshop up to date. Delays are possible, particularly on peak days with exceptionally high delivery volumes, in which case any claims for damages as well as further claims by the customer are excluded. No deliveries are made on Sundays or on official national or cantonal holidays. Dorbena is not liable for delivery delays beyond its control, e.g., due to force majeure, traffic congestion, strikes, poor weather conditions, etc., and such delays do not entitle the customer to either cancel the purchase contract or claim damages.

If the customer is not present at the time of delivery and has not provided any special delivery instructions, the package will be left at the apartment door, at the reception desk, or at the front door. If the customer’s mailbox is part of a shared mailbox system, the delivery person will leave a pickup notice in the mailbox. The customer must then pick up the package at the appropriate post office.

The customer assumes responsibility for the delivered products, even if they were not received directly by the customer.

Shipping Costs

In addition to the final price, the following shipping costs will be charged per order.

- CHF 10.00 for orders under CHF 100.00

- Free delivery for orders totaling CHF 100.- or more

Dorbena reserves the right to change the shipping costs for the products offered at any time.

Warranty

For the warranty against manufacturing defects, Dorbena applies the statutory period of 2 years from delivery. Dorbena may fulfill the warranty at its discretion by providing a partial or full replacement with an equivalent product, a credit note up to a maximum of the sales price at the time of the order, or a price reduction.

There is no general right of return for defect-free and correctly delivered products.

Notification of Defects

It is the customer’s responsibility to inspect the ordered products for completeness and condition immediately upon receipt. Dorbena’s customer service must be notified of any defects or discrepancies from the order via email to shop@dorbena.com within three days of accepting the delivery; otherwise, the delivery is deemed accepted.

If Dorbena identifies a manufacturing or shipping error, a replacement will be shipped free of charge. If the item is no longer available, the customer will be refunded the full purchase price.

If products are delivered with obvious damage to the packaging or to the contents, the customer must immediately file a complaint with the delivery person—regardless of their rights regarding defects—and refuse acceptance. The customer is obligated to obtain a damage report from the delivery person. All damage incurred during transport must also be reported to Dorbena immediately.

Returns

For hygienic reasons, returns or exchanges of correctly delivered goods without manufacturing defects are not permitted.

Payment Methods

Payments must be made in Swiss francs.

The available payment methods are listed in the online store.
